4. Nature of the Platform
Wsselni is a technology platform. Subject to applicable licensing and operational availability, the Platform may help Riders request ride-related services and may help Captains receive, accept, and manage such requests.
Unless expressly stated otherwise in writing, Wsselni does not itself own vehicles, employ Captains as employees, or operate as a transport carrier. Captains are responsible for complying with applicable driving, vehicle, insurance, safety, tax, and licensing requirements.
5. Eligibility
You must be at least 18 years old, legally capable of entering into binding agreements, and permitted under applicable law to use the Platform. Certain flows may require a higher age threshold based on safety, compliance, or product rules (for example, rider profile eligibility controls). Wsselni may refuse, restrict, suspend, or terminate access where eligibility requirements are not met.
6. Account Registration and Security
Users may be required to register using a mobile number, OTP verification, profile details, device information, and other information requested by Wsselni. You agree to provide true, complete, and current information and to keep your account secure.
You are responsible for activity occurring under your account, including activity caused by sharing your phone, device, OTP, or account access with another person.
7. Rider Terms
Riders are responsible for entering accurate pickup and destination information, being ready at the pickup point, treating Captains respectfully, paying applicable fares, and complying with safety instructions and applicable law.
Riders must not request illegal, unsafe, abusive, fraudulent, or misleading services, damage a Captain’s vehicle, avoid payment, harass Captains, or attempt to complete Platform-initiated rides outside the Platform.
8. Captain Terms
Captains must provide accurate personal, identity, vehicle, licensing, insurance, document, and payout information. Wsselni may require documents such as ID, driving licence, vehicle registration, insurance, criminal record certificate, vehicle photos, profile photo, and other information reasonably required for onboarding, safety, verification, or compliance.
Approval to use captain-facing features is not guaranteed. Wsselni may review, reject, suspend, or deactivate a Captain account based on document quality, eligibility, safety concerns, complaints, fraud risk, regulatory requirements, or operational policies.
Captains are responsible for safe driving, lawful vehicle operation, collecting cash fares where applicable, maintaining required vehicle condition and insurance, and complying with all applicable transport and road laws.
9. Service Categories
Wsselni may offer different service categories such as Wsselni Rides, Wsselni Pink, Wsselni Taxi, or other categories. Service categories may be limited by city, gender eligibility, vehicle type, captain status, regulatory approval, operational readiness, or availability.
Where Wsselni Pink or another safety-specific service is offered, additional eligibility, safety, or verification rules may apply.
10. Bookings, Cancellations, and Availability
Ride requests, captain matching, estimated arrival times, fare estimates, and availability are not guaranteed. A ride-related request may be accepted, rejected, cancelled, delayed, or unavailable due to captain availability, technical issues, traffic, safety, regulatory limitations, or other operational factors.
Cancellation fees may apply where communicated in the app. Wsselni may change cancellation rules from time to time.
11. Fares, Payments, Wallets, and Payouts
Fares may be calculated using distance, time, base fare, minimum fare, waiting time, demand/surge signals, city rules, tolls, taxes, discounts, promotions, cancellation fees, or other components shown in the app.
Payment methods may include cash, card, wallet, third-party processors, refunds, and adjustments where available. Some payment, wallet, ledger, and payout features may be unavailable, limited, or delayed based on rollout, provider readiness, or regulation.
Where enabled, captain earnings, payout balances, pending amounts, reserves, holds, refunds, and adjustments may be recorded in ledger systems. Wsselni may delay, adjust, reverse, or hold amounts for fraud review, disputes, chargebacks, refunds, technical correction, tax, or legal compliance.
Wallet or promotional balances may be subject to expiry, inactivity rules, withdrawal restrictions, or usage limits where communicated in the Platform and permitted by law.
12. Promotions and Referrals
Wsselni may offer promotions, coupons, referrals, discounts, free credits, or incentives. Such offers may be subject to eligibility, time limits, geographic limits, account limits, minimum fare requirements, service category limits, and anti-abuse rules. Wsselni may withdraw or adjust offers where misuse, fraud, or error is suspected.
13. Safety, Conduct, and Prohibited Use
Users must not use the Platform for fraud, abuse, harassment, discrimination, unsafe conduct, impersonation, document falsification, GPS manipulation, hacking, scraping, reverse engineering, spam, illegal transport activity, money laundering, payment abuse, or any act that harms Wsselni, another user, or the public.
Users must not arrange, solicit, accept, or complete a ride outside the Platform where the original match, contact, request, or interaction was initiated through Wsselni.
14. Fraud Policy
Your use of the Platform is also subject to Wsselni’s Fraud Policy. Wsselni may suspend, restrict, investigate, deactivate, adjust balances, hold earnings, reverse credits, or report conduct to authorities where fraud, unsafe activity, illegality, or misuse is suspected.
15. User Content and Communications
You may submit profile photos, vehicle photos, documents, ratings, reviews, support messages, incident reports, and other content. You confirm that your submissions are accurate and that you have the right to provide them. Wsselni may use such content to operate, verify, support, improve, and protect the Platform.
16. Privacy
Wsselni processes personal data in accordance with its Privacy Policy and, for website tracking, its Cookies Policy. By using the Platform, you acknowledge that personal data may be processed for account management, verification, safety, ride-related functions, payment, ledger, support, analytics, fraud prevention, and legal compliance.
Account authentication uses mobile OTP verification and device/session controls. By using the Platform, you agree to these authentication and account-security controls.
17. Third-Party Services
The Platform may rely on third-party services such as payment providers, payout providers, SMS/OTP providers, cloud hosting, object storage, maps, analytics, crash reporting, document verification, OCR, face matching, and customer support tools. Third-party services may have their own terms and privacy practices.
18. Suspension and Termination
Wsselni may suspend, restrict, or terminate your access to all or part of the Platform if you breach these Terms, create risk, fail verification, engage in fraud or abuse, create safety concerns, violate law, or where required by regulator, court order, operational necessity, or compliance review.
19. Disclaimers
The Platform is provided on an “as is” and “as available” basis. Wsselni does not guarantee uninterrupted service, exact fare estimates, availability of Captains, availability of Riders, error-free software, successful payment processing, or permanent access to any feature.
20. Limitation of Liability
To the maximum extent permitted by law, Wsselni is not liable for indirect, incidental, special, consequential, punitive, or loss-of-profit damages arising from use of the Platform. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
21. Indemnity
You agree to indemnify and hold Wsselni harmless from claims, losses, damages, liabilities, penalties, and expenses arising from your use of the Platform, breach of these Terms, violation of law, fraud, misuse, unsafe conduct, or infringement of another person’s rights.
22. Intellectual Property
Wsselni’s name, logo, software, design, content, trademarks, platform structure, and related intellectual property belong to Wsselni or its licensors. You may not copy, modify, reverse engineer, distribute, sell, or misuse them without written permission.
23. Changes to These Terms
Wsselni may update these Terms from time to time. The updated version will be posted on the website or app with a revised date. Continued use of the Platform after an update means you accept the updated Terms.
24. Governing Law and Jurisdiction
These Terms are governed by Laws of Jordan, unless mandatory consumer or local laws provide otherwise. Disputes shall be submitted to Competent courts of Jordan, except where applicable law requires another forum.
